CreativeImage Headshot Photography Terms & Conditions

Service Provider: CreativeImage Estate Service Ltd, trading as CreativeImage / CreativeImage.uk, Photographer Tomasz Skoczen (“CreativeImage”, “Photographer”, “we”, “us”, “our”).

Client: The person or organisation booking the photography service (“Client”, “you”, “your”).

By booking a headshot photography session, you confirm that you have read and accepted these Terms & Conditions.

1. Booking and Payment

A £50 booking payment is required to confirm the appointment. This amount is credited towards the selected package.

The remaining balance becomes payable after the Client has received the proofs and selected the required final images.

Proofs will normally be supplied within 5 days of the photography session. The Client should make their selection and pay the remaining balance within 7 calendar days of receiving the proofs. Extensions may be agreed at the Photographer’s discretion.

Professional retouching will begin after the remaining balance has cleared.

No VAT is charged.

2. Proofs and Final Images

Proofs are pre-enhanced preview images provided for image selection. They are not the final professionally retouched photographs and may include a watermark or other protection.

Final professionally retouched images will normally be delivered within 5 days after the remaining payment has cleared.

The number of final images supplied is determined by the package booked.

3. Photography Session

The session times stated in the package descriptions are approximate. The actual photography time may be shorter or longer depending on the location, available space, lighting, surroundings, subject requirements and the nature of the photographs being created.

Outdoor photography is subject to weather, available natural light, surrounding conditions, access, safety and any applicable photography restrictions. The Photographer may reasonably modify, relocate or reschedule outdoor photography where conditions make the planned photographs impractical or unsuitable.

4. Travel and Additional Costs

Photography within the Milton Keynes area is included in the package price, subject to the stated package terms.

For locations more than 10 miles from Milton Keynes, an additional travel charge of £0.50 per mile may apply to the additional distance.

The Client is also responsible for any additional reasonable costs directly related to the location, including paid parking, tolls, congestion charges, paid roads, access charges or similar expenses.

Any known additional charges will be communicated where reasonably possible.

5. Copyright

All copyright and ownership rights in the photographs remain with Tomasz Skoczen / CreativeImage Estate Service Ltd.

Booking or payment for the photography service does not transfer copyright ownership to the Client.

The Client receives a non-exclusive, non-transferable licence to use the final supplied photographs for their own professional and personal-brand purposes, including:

LinkedIn, CVs, professional profiles, personal or company websites, social media, business biographies, press and editorial profiles, presentations, networking, marketing and promotional materials relating to the Client or their business.

The photographs may not be sold, sublicensed, assigned, redistributed as stock imagery or supplied to third parties for their own commercial use without the Photographer’s prior written permission.

The Client may crop or resize the photographs for normal digital or print use, but may not materially alter, manipulate or edit the photographs in a way that misrepresents the Photographer’s work.

6. Photographer’s Portfolio and Marketing Use

The Photographer may request permission to use selected photographs from the session for CreativeImage’s portfolio, website, social media, advertising and other promotional purposes.

Any permission for identifiable photographs of the Client for these purposes will be obtained through a separate marketing consent option and is not required to purchase the photography service.

Where marketing consent has been given, the Client may withdraw that consent at any time by written notice. The Photographer will stop new promotional use within a reasonable period, although material already published or printed before withdrawal may not always be capable of immediate removal.

7. Permissions and Releases

The Client is responsible for obtaining any permissions, consents or releases required for the photography session or for the people, premises, artwork, products, trademarks, documents or other objects appearing in the photographs.

The Photographer is not required to independently verify such permissions and accepts no responsibility for claims arising from their absence.

8. Cancellation, Rescheduling and No-Show

The Client may cancel or reschedule a photography appointment free of charge before the Photographer has travelled to the agreed location.

If the Photographer has already travelled to the Client’s agreed location and the Client cancels the session, is unavailable, or fails to attend without reasonable notice, a £30 call-out/cancellation fee will apply, together with any applicable travel, parking, toll, access or other reasonable location-related expenses already incurred.

Where the Photographer is required to wait because the Client is delayed, the first 15 minutes are provided without charge. After 15 minutes, waiting time is charged at £25 per hour, calculated from the end of the initial 15-minute period.

The maximum waiting period is 1 hour and 15 minutes from the agreed appointment time. After this period, the booking will be treated as a Client no-show, and the £30 call-out/cancellation fee plus any applicable travel-related expenses will become payable.

The £50 booking payment remains credited towards the booked photography package unless otherwise stated in these Terms & Conditions.

9. File Retention

Proof galleries and final download links are normally retained for a limited period. Clients are responsible for downloading and securely storing their final photographs.

CreativeImage is not responsible for retaining files indefinitely or for loss of files after the stated retention period.

10. General

CreativeImage will make reasonable professional efforts to provide images consistent with the style and quality shown in its portfolio and service examples.

The Photographer reserves reasonable creative control over lighting, posing, composition and image processing in order to achieve the best result for the agreed service.

These Terms & Conditions are governed by the laws of England and Wales.
